Welcome to the CRED club! At CRED we are creating a system that strives to reward high trust and creditworthy individuals of India, inspiring others to be like them.

Eligibility

By registering with CRED and accessing the CRED Services, you are representing the following:

a. You are capable of entering into a legally binding agreement;

b. You are not barred or otherwise legally prohibited from accessing or using the CRED App and CRED Services;

c. You agree to seek your credit score from Credit Information Companies using the CRED App and disclose the said credit score to CRED. CRED may use the said credit score to determine your eligibility for access to various CRED Services. CRED may at its sole discretion prevent Users from accessing the CRED App and the CRED Platforms in part or in whole if the credit score of a User is lower than a minimum entry threshold set by CRED from time to time;

d. If You onboarded on the CRED App on or before September 30, 2023, You confirm that you were 18 years of age or older at the time of onboarding. If You onboarded on the CRED App on or after October 1, 2023, You confirm that you were 21 years of age or older at the time of onboarding; and

e. If you allow anyone to use your account, including individuals under 18 years of age, you will still be responsible for ensuring that such individuals comply with these Terms of Use. You will be responsible for all actions these individuals take in and/or through your account. You also acknowledge that CRED does not have the responsibility of ensuring that You meet the aforesaid eligibility requirements.

Please read the terms and conditions carefully before registering, accessing or using the CRED Services (defined below) offered through the cred.club website, CRED App (defined below) or through applications or websites of CRED Group Entities (defined below). These terms and conditions are a legal contract ("Terms of Use") between You and Dreamplug Technologies Private Limited (“CRED”) having its registered office at 404 Uphar II CHS Ltd., Plot No.5, BHD Sanjeeva ENCL, 7 Bunglows, Near Juhu Circle, Mumbai, Maharashtra 400 061 and its corporate office at CRED, No. 769 and 770, 100 Feet Road, 12th Main, HAL 2nd Stage, Indiranagar, Bangalore 560038. You agree and acknowledge that you have read the terms and conditions set forth below. If you do not agree to these Terms of Use or do not wish to be bound by these Terms of Use, you may not use the CRED Services and/or immediately terminate the Services and/or uninstall the CRED App.

1. Definitions

“CRED”, “Dreamplug” “We”, “Us”, “Our” means CRED and CRED Group Entities.

“You”, “Yours”, “Yourself”, “User” means any prospective user, or registered user of CRED and CRED Group Entities, including but not limited to customers and Commercial Partners.

“CRED App” means mobile application(s), hosted by CRED and CRED Group Entities for providing services to the Users, and Commercial Partners.

“CRED Group Entities” means subsidiaries and affiliates of CRED.

‘CRED Platform” means any platform owned/subscribed/used by CRED or CRED Group Entities including but not limited to the CRED Website, the CRED App, other mobile applications, devices, URLs/links, notifications, chatbots, CRED’s social media channels or any other communication medium or mechanism used by CRED or CRED Group Entities to provide services to the Users.

“CRED Website” means  https://cred.club or any other website hosted or registered by CRED or CRED Group Entities.

“CRED Services” means and include all services offered / to be offered by CRED, and CRED Group Entities either directly or through its Commercial Partners including but not limited to CRED Max Services, CRED Cash Services, Credit Card Bill Payment Services, CRED Pay Services, Rewards and CRED Store Services; and in relation to Merchants, also includes Payment Aggregator Services.

“Commercial Partner” means any individual or entity with whom CRED or CRED Group Entities have a contractual relationship and includes but is not limited to entities offering rewards on CRED App, Sellers, Lenders, CRED Pay Merchants etc.

“Sellers” means entities offering goods for sale to the Users via CRED Store.

“Terms of use” / “Terms and Conditions” are interchangeably used and mean these Terms of Service including the Supplemental Terms.

2. Your Use of CRED

You agree that:

a. Unless otherwise permitted by CRED in writing, You may only possess one account.

b. Your use of the App shall not violate any applicable law or regulation.

c. Your use of the CRED App, and CRED Platforms shall be only for personal purposes.

d. All registration information you submit is truthful, complete and accurate and you agree to maintain accurate, complete and up-to-date account information in your account.

e. You are responsible for all activity that occurs under your account.

f. You are responsible for maintaining the confidentiality of the access credentials of your account and are fully responsible for all activities that occur under your account. You agree to immediately notify CRED of any unauthorized use of your passcode or account or any other breach of security.

g. You agree that You are aware and responsible for all transactions taking place through your Account. You shall continue to be responsible for the transactions in your account, if you knowingly or negligently (i) grant any other person access to your CRED App, (ii) permit them to transact on Your account, or (iii) transact on any other person’s behalf or directions; whether by sharing one-time passwords or in any other manner. 

h. You shall not indulge in decompiling, reverse engineering, disassembling content, removing any intellectual property right associated with the CRED App, including our copyright, trademarks, trade secrets, designs, and patents, or other proprietary notices.

i. You shall not access or use the CRED App in any manner that (i) may be harmful to the operation of the CRED App or its content; (ii) may be unlawful; (iii) maybe harmful to CRED or to any other User; (iv) may hinder the other User’s enjoyment of the CRED App; or (v) to defraud other Users, CRED or any Commercial Partner.

j. You shall not post, distribute, or otherwise transmit or make available any software or other computer files that contain a virus, other harmful component or malicious content, or otherwise impair or damage the CRED App or any connected network, or otherwise interfere with any person or entity's use or enjoyment of the CRED App.

k. You shall not delete or modify any content of the CRED App.

l. Your use of the CRED App shall indicate that you have provided consent to automatically receive updates such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, ‘Updates’), for the purpose of effective delivery of the CRED Services. Please note that your continued use of the CRED App following such Updates would mean deemed acceptance by you of the same.

m. You understand and accept that not all products, services and rewards offered on the CRED App are available in all geographic areas and you may not be eligible for all the products, services and rewards offered by CRED on the CRED App or other CRED Platforms. CRED reserves the right to determine the availability and eligibility for any product, services and rewards offered on the CRED App or any CRED Platform.

n. You shall request CRED, to block the Account and change the passcode immediately for the account, if your device has been lost or stolen.

o. You agree that if you purchase any insurance policies via the CRED App, the nominee for such policy shall be Your legal heirs (if stated therein, and if not stated, the same shall be read to mean that no nominees are listed), and You will contact the respective insurer who has issued you the policy to make any updates to the nominees. CRED and the CRED Group Entities shall not be responsible for any change required to be made in the list of nominees to Your insurance policies.

p. You understand that if You avail insurance on the CRED App, our insurance partners may seek medical information from any doctor / hospital who / which at any time has attended to You, or from any past or present employer concerning anything which affects Your physical / mental health, and seeking information from any other insurer to whom an application for insurance on You has been made for the purpose of underwriting the insurance proposal and / or claim settlement. You also authorise such insurance partners to share information pertaining to You, including Your medical records, for the sole purpose of underwriting the insurance proposal and / or claim settlement and with any governmental and / or regulatory authority. The insurance partner may also contact You regarding any insurance you have availed / applied for, and for any servicing / claims settlement or other similar activities.

3. Supplemental Terms and delivery of services through CRED Group Entities

You agree and acknowledge that several features including but not limited to CRED Garage, CRED Max, CRED Cash, CRED Pay, Credit Card Bill Payments and Rewards, are subject to certain supplemental Terms of Use set out below (or where applicable, as set out in www.daspl.co.in). Your usage of any features that have a set of Supplemental Terms of Use is deemed to be acceptance of the said Supplemental Terms of Use.  You further agree that any CRED Services may be provided to You either directly by CRED or by any CRED Group Entity and in particular, any payment to you or made by you may be routed through Dreamplug PayTech Services Private Limited (“Payment Aggregator”).

4. Violation of Terms of Use / Suspicious Activity

If We believe that you have violated any of the conditions as mentioned under these Terms of Use, our Privacy Policy, Supplemental Terms applicable to certain services or any agreements consented to via the CRED App, we reserve the right to suspend your access to the CRED App and/or delete your account without prior notice to You, and reverse any transaction undertaken by You. If We have reason to believe that there is suspicious or unusual activity being carried out through your account, we may temporarily or permanently suspend your access to the CRED Services, and reverse any transaction undertaken by You. If we suspect that any feature, offer or reward promotion is being availed by You in a manner (i) that is disingenuous (for example: placing orders without intending to take delivery or intending to subsequently cancel all or substantially all of them); (ii) that it is not intended to be availed; (iii) that purports to artificially increase (or decrease) your transaction volume or usage of the App (for example: paying rent or credit card bills by breaking them down into numerous smaller transactions); (iv) that is designed to deliberately side step fair use restrictions; (v) that may result in you gaining an undue, unfair or unethical advantage over other Users or Commercial Partners; (vi) that is intended to cause losses or other harm to Commercial Partners, CRED reserves the right to reverse the relevant transaction, suspend the account or restrict you from using the App in its entirety or any specific feature(s) thereof. CRED may ask for additional information / documents if required from time to time including but not limited to Your permanent account number (PAN), in connection with the above. In case you fail to provide such information / documents to CRED’s satisfaction, CRED may reverse any transactions undertaken by You, and may suspend Your account or restrict You from using the App or any of its features.

You may reach out to the CRED support team to assist you with any query or question arising as a result of the aforementioned suspension/ deletion.

5. Termination / Deletion of Your Account

You may end your legal agreement with CRED at any time by deactivating your account and discontinuing the use of the CRED Services. We provide all our Users an option through which a User may request archive of a specific card stored on his/her account or deletion/deactivation of the complete account through the support section on the CRED App.

Following a request for deletion, or termination of account by CRED, We consider the agreement to be terminated and take appropriate steps. Provided however, CRED may continue to maintain transaction records for record keeping purposes and/or regulatory reasons. Deletion of the account or Termination also does not terminate Your obligations undertaken prior to deletion or termination of the account including but not limited to the obligation to repay any loan or credit line availed by You. CRED may continue to retain a record of your transactions made on the CRED App for regulatory and archival purposes.

6. Fees

You are responsible for any fees that may be applicable to certain transactions or use of the CRED App; where you will be notified of such applicable fees, prior to the completion of any transaction. By clicking ‘Proceed’ / ‘Submit’ / ‘Continue’ or any other similar button on the CRED App, You shall be deemed to have consented to the fees displayed on the said page.

7. Loyalty Points

CRED offers its users loyalty points in various forms for their regular and continuous use of the CRED App. These loyalty points are provided for performing various actions on the CRED App. Each user who makes his/her credit card payments through the CRED App earns loyalty points (“CRED Coins” or “Coins”), and the number of CRED Coins earned may vary per transaction. These loyalty points / CRED Coins are rewarded purely for the regular use of the CRED App and the CRED App does not permit any purchase or accrual of these loyalty points in any other way. These loyalty points may be redeemed by Users to participate in various rewards/offers that are run by the CRED App for all users from time to time.

CRED reserves the right, at its sole discretion, to change the mode of the accrual of one or any of these types of loyalty points, including the number of such loyalty points received in proportion to the User’s activities. Further, CRED reserves the right to disqualify any User, who does not meet the offer requirements or for any other reason including but not limited to any misuse of the offer or fraud or suspicious transaction/activity or under any legal requirement or applicable rules and regulations, from receiving any loyalty points. CRED also reserves the right to discontinue or change or issue any new form of loyalty points offered at any time, at its sole discretion. CRED may also at its discretion specify an expiry period for the CRED Coins.

8. Privacy

We collect, hold, use and transfer your personal data in accordance with our Privacy Policy. By agreeing to the Terms of Use, you also hereby agree to our Privacy Policy, which may be updated and/or modified by us from time to time. You understand and agree that, to the extent permitted by applicable law, any data provided by you in connection with the CRED Services may be shared with our subsidiaries, affiliates or partners, and/ or used by us for enhancing the CRED Services, including but not limited to creating new products. Please refer to the Privacy Policy for further clarity on the subject.

9. Disclaimer

The CRED Services, including all content, software, functions, material, and information made available or accessible through the CRED Platform are provided “as is”. CRED, CRED Group Entities and their respective agents, co-branders or partners, make no representation and warranty of any kind for the content, software, functions, material, and information available/accessible through the Services.

CRED does not warrant that the functions contained in content, information and materials on the CRED App, including, without limitation any third-party sites or services linked to the CRED App or any CRED Platform will be uninterrupted, timely or error-free, that the defects will be rectified, or that the CRED App or the servers that make such content, information, and materials available are free of viruses or other harmful components.

Further, You understand that a payment transaction is solely between the User who uses the CRED Services to make his payment (“Sender”) and the User who receives such payment from the Sender (“Recipient”) and that CRED does not provide any guarantees or warranties to any User with respect any service, goods, or delivery level commitment provided by the Recipient. CRED cannot assure that Commercial Partners or other Users are or will be complying with the foregoing Terms of Use or any other provisions mentioned here. You assume all risk of harm or injury resulting from any such lack of compliance by any other User or Commercial Partner. You should ensure that you have undertaken adequate due diligence prior to transferring payments using the CRED App.

10. Limitation of Liability

In no event shall CRED, CRED Group Entities, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, or contractors be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages or losses whatsoever, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether CRED has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of, or access to, the CRED Platforms, CRED App or CRED Services.

In no event shall CRED and CRED Group Entities’ total cumulative liability to You in connection with the CRED Services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the CRED App and CRED Platforms or arising from these Terms of Use exceed INR 10,000 (Indian Rupees ten thousand only).

11. Indemnity

You agree to defend, indemnify and hold harmless CRED, CRED Group Entities, its officers, owners, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, contractors and other applicable third parties (collectively ‘Indemnified Parties’) from and against any and all claims, demands, damages, obligations, losses, liabilities, cause of action, costs or debt, and expenses (including any legal fees) arising from:

a. your use of and access to the CRED App and the CRED Platforms;

b. your violation / breach of any of these Terms of Use;

c. your violation of any third party right, including any intellectual property right or privacy right;

d. the committing of any of the prohibited activities as stated herein;

e. your failure to be in compliance with applicable law, including tax laws and cyber security laws; or

f. any claim that your use of the CRED App caused damage to a third party.

12. Disputes & Arbitration

In consideration for CRED granting you access to and use of the CRED App, CRED Platforms and CRED Services, you agree that in case of any dispute between You and any Commercial Partner or other User or recipient of the funds transferred by You, CRED shall not be a party to the same. While CRED is not obligated to mediate or resolve disputes, CRED will assist Users in communicating with each other regarding a dispute. CRED may at its own discretion however, without having any obligation to do so, assist in resolving the disputes between the Users and the Commercial Partners.

Except as otherwise set forth in these Terms of Use, these Terms of Use shall be exclusively governed by and construed in accordance with the laws of India. Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the CRED Services or these Terms, including those relating to its validity, its construction or its enforceability, but excluding those provisions where it has been specified that CRED’s decision shall be final,  (any “Dispute”) shall be, if initiated by the User, first raised by the User to CRED customer support through the CRED App and if not suitably resolved, the user may raise a grievance using the Grievance Redressal Form. If such Dispute has not been settled within sixty (60) days after the User reaches out to the aforementioned email IDs, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). Provided however when CRED raises any dispute, CRED may directly initiate arbitration in accordance with this clause. The Dispute shall be resolved by one (1) arbitrator to be appointed by CRED. The place the arbitration shall be Bangalore, India. The language of the arbitration shall be English. The existence and content of the arbitration proceedings, including documents and briefs submitted by the parties, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

13. Use and Protection of Intellectual Property Rights

CRED App, CRED Website, CRED logos and the CRED Services are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the CRED App including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, tradenames may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Our express written permission. You are hereby given a limited licence to use the CRED App and the CRED Platforms, subject to your agreement of these Terms of Use.

CRED, CRED Group Entities, and its licensors, if any, are the sole owners of the underlying software and source code associated with the CRED App and CRED Platforms as well as any other intellectual property rights of any other nature associated with the CRED App, CRED Platforms and their content.

When you upload, submit, store, send or receive content that may include feedback to or through the CRED App, you give CRED and CRED Group Entities a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. This licence shall not expire even if it is not used by CRED or CRED Group Entities. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the CRED Services, and to develop new ones. This licence continues even if you stop using the CRED Services.

14. Tax Liability

You hereby agree to comply with any and all applicable tax laws in connection with your use of the CRED Services, including without limitation, the reporting and payment of any taxes arising in connection with payments made through the CRED App, or funds/income received through the CRED Services.  You hereby agree and acknowledge that if and when required by applicable law, CRED, may deduct tax deducted at source from your winnings/ cashback (credited as CRED Balance or otherwise) and/or may require You to submit PAN details before providing you cashback or other winnings.

15. Governing Law and Jurisdiction

The CRED App, the CRED Services, all your transactions with the CRED App, and our relationship shall be governed by the laws of India, without regard to conflict of law principles. You agree that subject to the Disputes & Arbitration Clause above, all claims, differences and disputes which we may have shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.

16. Assignment

You shall not transfer or assign any of Your rights and obligations arising from these Terms of Use.

You agree and acknowledge that CRED may assign or transfer its rights and obligations under these Terms of Use in whole or in part, to (i) any other CRED Group Entity; (ii) an acquirer of CRED or any CRED Group Entity or their respective equity interest, business or assets; or (iii) a successor entity resulting from any corporate action including mergers or demergers.

17. General

No joint venture, partnership, employment or agency relationship exists between you, CRED, CRED Group Entities or any Third Party as a result of the contract contained in these Terms of Use. If any provision of these Terms of Use is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms of Use but the legality, validity and enforceability of the other provisions in these Terms of Use shall not be affected. In that event, CRED shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms of Use. These Terms of Use (together with any additional terms displayed in specific sections of the CRED App or CRED Website) constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.

18. Updation

We may amend these Terms of Use at any time by posting an updated version on the CRED Website. The updated version of these Terms of Use shall supersede the previous version of the Terms of Use and take effect immediately upon posting. You have the right to opt-out of agreeing to these Terms of Use or any future updated version of the Terms of Use, by ceasing to use the CRED App. However, please be aware that your continued use of the CRED Services from the launch of any updated Terms of Use would mean deemed acceptance of such updated Terms of Use including any modification thereof. We recommend you to keep checking the Terms of Use often to be familiar with any updates and changes.

Section A: Supplemental Terms for Credit Card Bill Payments

The following terms and conditions (“CRED CCBP T&Cs”) are specific to the use of the Credit Card Bill Payment (CCBP) feature:

A.1. Personal Use

a. You may use the CCBP feature only for personal purposes. You are not permitted to offer it to other persons or entities on a commercial basis.

b. You also agree that You will only make genuine payments/ transactions, and that CRED may reverse the transaction if it suspects that the transaction is not genuine. You agree not to use the CCBP feature for money laundering, terrorist financing, illicit payments or any other use which is either prohibited by law or is unethical.

c. By making a payment for a Credit Card that does not belong to You, You assume responsibility for the transactions that have taken place through that Credit Card for the cycle the payment is made by You using the Services.

d. CRED may ask for additional information / documents if required from time to time including but not limited to Your permanent account number (PAN), to verify the underlying transactions. In case you fail to provide such information / documents to CRED’s satisfaction, CRED may reverse your transactions, and you may be unable to use the CCBP features offered by CRED.

A.2. Credit Card information

You are responsible for all the information you input during your use of the CRED App including the CCBP feature.

In particular you are responsible for ensuring the correctness of (i) details of the credit card for which payment is being made; (ii) details of the payment instrument from which the payment is being made; and (iii) the amounts of payment. In the event you input any of these details incorrectly, You will be responsible for the resultant transaction and all charges that result from the same. CRED may at its own discretion, without having any obligation to do so, assist in reversing such transactions if technically feasible and viable for CRED.

You agree that credit card details input for CCBP transactions shall be saved or tokenised to allow the usage of the same credit card for other CRED Services.

A.3. Refunds

CRED shall not be responsible for any payment for an incorrect credit card account input by You / using Your account. In case, money has been charged to payment instrument and not credited to Your credit card within 72 (seventy-two) working hours of your completion of the transaction then You may inform us regarding the same through the customer support section of the CRED App. We shall investigate such incidents and if it is found that money was indeed charged to your payment instrument without delivery of the payment/service then You will be refunded the money within twenty-one (21) working days (or such other timeline as mandated by applicable law) from the date of receipt of Your query on the CRED App or over email. All refunds will be credited to the payment instrument originally used or Specified Refund Account. CRED may allow You to verify a specific refund account (Specified Refund Account) to which all the refunds for failed may be credited. CRED will have the sole discretion to determine the mode of reversal from the above mentioned options, in accordance with applicable laws. However, CRED disclaims any and all liability, including for refunds, in the event of any error arising from a failure in the applicable bank, card network or any other intermediary credit card service provider’s systems or networks.

In case a payment has been wrongfully made and credited to your credit card account or bank account, CRED reserves the right to automatically initiate a refund through your bank. You hereby consent to such a refund initiated by CRED and / or Your bank, at the request of CRED, to offset any incorrect transaction, credit or double payment made to your account. Once such transaction is processed, CRED shall inform you of the same and the corrective action taken by CRED to refund such payment.

A.4. Limited time offers

CRED may either directly or in partnership with its Commercial Partners run limited time offers allowing Users to win cashback or other benefits on payment of their credit card bills (which may be credited as CRED Balance or otherwise). CRED reserves the right to introduce, withdraw or vary the terms of such offers from time to time. Any benefits advertised or displayed on the CRED App or through other media channels shall be indicative and the benefits may be of the advertised amount or lesser. Any advertisement or benefits amount displayed on the CRED App shall be deemed to be offering the winners benefits ‘up to’ such amount regardless of whether the word up to is used in such advertisement, display or marketing material on any channel.

A.5. Powerplay offers

Eligible Participant: Each User who pays their credit card bills on the CRED App during the subsistence of the power-play segments of the cricket matches specified on the CRED App, at the time of each match’s live telecast (“Power-Plays)”, shall be eligible to participate in the CRED Power Play Offer (“Power-Play Offer”).

Winner: CRED will select 1 (one) winner from the Eligible Participants per match. CRED’s decision in this regard shall be final and binding. By participating in the Power-Play Offer, each Eligible Participant agrees that if selected as Winner, they shall share with CRED any information /photos / quotes /cooperation requested by CRED for marketing purposes.

Prize: The selected Winner shall receive from CRED as cashback (whether as CRED Balance or otherwise), an amount equal to the amount of credit card bill paid by such Winner during the Power-Play (or such other amount as advertised on the CRED App for a specific power play offer). Such amount shall be credited directly to the credit-card or bank account or to the CRED Balance of the Winner, at CRED’s discretion.

Disclaimers: CRED is not responsible for any tax implications on any Eligible Participant from their participation in the Power-Play Offer. No person is guaranteed any rewards or cash-back in respect of the Power-Play Offer.

A.6. Kill the Bill offers

Eligible Participant: Each User who sees the offer activated on the CRED App at the time of making a transaction, shall be eligible to participate in the CRED KTB Offer (“KTB Offer”). As an Eligible Participant, You may claim KTB Offers only on eligible transactions.

Eligible Transactions: Any genuine payments made to unique VPAs (virtual payment addresses) of a minimum value of INR 1 (Indian Rupees One only) each (or such other minimum value as may be displayed on the KTB Offer screen), made using CRED UPI.

Winner: CRED, at its discretion, will select one or more winners from the Eligible Participants who have made the minimum number of Eligible Transactions as displayed on the CRED App. CRED’s decision in this regard shall be final and binding. 

Prize: The selected winners will receive from CRED as cashback, an amount equal to the amount as advertised on the CRED App for such User. 

Disclaimers: CRED may introduce, vary and withdraw such offers at its discretion without prior notice to the Users. Different sets of Users may have different offers from time to time. CRED reserves the right to modify or suspend the KTB Offer at any time without prior notice to the Users. No person is guaranteed any rewards or cashback in respect of the KTB Offer. CRED does not guarantee that any User shall be eligible for any offer or that the benefits offered will be same or similar to all users. 

Section B: Supplemental Terms for CRED Max

The following terms and conditions (“CRED Max T&Cs”) are specific to the use of the rent and allied payments, business expense payment sand educational fees payments products introduced by CRED (“CRED Max”). All Users using CRED Max shall be deemed to have read, understood and agreed to be bound by these CRED Max T&Cs.

B.1. Eligibility

CRED shall make CRED Max available to some or all of CRED Users at its sole discretion. CRED may also suspend or discontinue offering CRED Max for any CRED Users at its sole discretion.

B.2. CRED’s role

a. CRED Max allows You to use Your credit card to make payments to their landlords / apartment complexes / housing societies (in case of Rent Pay), suppliers (in case of business expense payments) and educational institutions (in case of educational fees payment product), collectively referred to hereinafter as Counterparties.

b. When you instruct CRED to pay, You authorize us and order us to commit your payment (less any applicable fees or other amounts we may communicate and collect from You for providing such Services) to such Counterparty.

c. You acknowledge that the Counterparty may not be a CRED user and that CRED has no contractual relationship with the Counterparty. CRED is not and shall not be deemed to be Your agent or the agent of any Counterparty. Except for CRED’s limited role in enabling the payment after receiving specific directions from You, CRED is not involved in any underlying transaction between You, and the Counterparty.

B.3. Indemnification

a. You agree to not hold CRED responsible and/or liable for any issue or claim arising out for any dispute whatsoever between You and the payment gateway or Your bank or the Counterparty.

b. You shall keep CRED indemnified and hold CRED harmless in the case of any third-party claims against CRED (whether by the Counterparty, payment gateway, bank, any government authority or any other Person) for the payments made or attempted to be made by You (or any other Person through your account) using CRED Max.

B.4. Information Input

a. You are responsible for all the information you input during your use of the CRED App including the CRED Max features.

b. In particular you are responsible for ensuring the correctness of (i) details of the Counterparty’s bank account to whom payment is intended to be made; (ii) details of the payment instrument (or selection from the saved credit cards) using which payment is to be made; and (iii) the amounts of payment. In the event you input any of these details incorrectly, You will be responsible for the resultant transaction and all charges that result from the same. CRED may at its own discretion, without having any obligation to do so, assist in reversing such transactions if technically feasible and viable for CRED.

c. CRED may ask for additional information if required from time to time including but not limited to Counterparty’s permanent account number (PAN), your PAN, rental agreements etc to verify the underlying transactions, and in case you fail to provide such information then you may be unable to use the CRED Max features offered by CRED.

d. In particular, if the rental amount to be paid by You is more than INR 50,000/- (Rupees Fifty Thousand Only), submission of landlord’s PAN is mandatory. Without such information, the payment will not be processed. Further, CRED may ask for additional documents in case a transaction appears to be suspicious. Failure to provide such documentation within 72 hours may result in your transaction failing and at CRED’s sole discretion, Your access to CRED Max being revoked.

e. You are responsible for ensuring that all the payment details provided by you are accurate.

B.5. Disclaimers

a. Once a payment has been initiated it cannot be reversed and CRED will not be liable in any way for any loss You suffer as a result of a transaction being carried out in accordance with the instructions issued by You.

b. CRED shall process the payment only after CRED has received (i) the payment from your credit card or other relevant payment instrument; and (ii) any further information requested from You by CRED. CRED shall not be responsible for any delay occasioned due to any action or inaction on account of any bank or payment gateway involved in your transaction.

c. CRED does not guarantee any timelines for payments to the Counterparties. Any timelines mentioned on the CRED App or other CRED Platforms are merely indicative in nature and not to be construed as guarantees.

d. While CRED undertakes its best efforts to process the payment as directed by you at the earliest, CRED may delay, suspend, or reject a transaction for any payment(s) for any reason, including without limitation if we suspect the transaction poses a financial or security risk, or is unauthorized, or is fraudulent, suspicious, unlawful or in any way in violation of the applicable laws around such transactions or in violation of these CRED Max T&Cs, subject to dispute or otherwise unusual.

B.6. Chargebacks

a. The amount of a transaction maybe charged back (‘Chargeback’) if the transaction is (i) disputed by cardholder; (ii) reversed for any reason; (iii) not authorized by cardholder or if CRED or the issuing bank has reason to believe that it is not authorised; or (iv) is considered unlawful or in breach of these CRED Max T&Cs.

b. In case of a Chargeback, You will owe CRED and will be required to immediately pay CRED the amount of any Chargeback and any associated fees, fines or penalties as assessed by the payment gateway, bank, card association or processor. You agree to assist CRED when requested to investigate any of your transactions made using the CRED App. Your failure in providing timely assistance to CRED, including without limitation providing documentation, where required within 72 hours, may result in an irreversible Chargeback.

c. Further in such cases your use of CRED Max or the entire CRED App and CRED Platform maybe blocked for an indefinite period of time as decided by CRED on a case-to-case basis.

B.7. Prohibited Transactions

a. You agree to use CRED Max features only for the intended purposes and not for money laundering, terrorist financing, illicit payments or any other use which is either prohibited by law or is unethical.

b. In particular you also agree not to use the CRED Max feature to pay any amount directly or indirectly for the following good / services:

1. Adult goods and services which includes pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services; Website access and/or website memberships of pornography or illegal sites;

2. Alcohol which includes alcohol or alcoholic beverages such as beer, liquor, wine, or champagne;

3. Body parts which includes organs or other body parts;

4. Bulk marketing tools which includes email lists, software, or other products enabling unsolicited email messages (spam);

5. Cable descramblers and black boxes which includes devices intended to obtain cable and satellite signals for free;

6. Child pornography which includes pornographic materials involving minors;

7. Copyright unlocking devices which includes Mod chips or other devices designed to circumvent copyright protection;

8. Copyrighted media which includes unauthorized copies of books, music, movies, and other licensed or protected materials;

9. Copyrighted software which includes unauthorized copies of software, video games and other licensed or protected materials, including OEM or bundled software;

10. Counterfeit and unauthorized goods which includes replicas or imitations of designer goods; items without a celebrity endorsement that would normally require such an association; fake autographs, counterfeit stamps, and other potentially unauthorized goods; 

11. Drugs and drug paraphernalia which includes illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms; 

12. Drug test circumvention aids which includes drug cleansing shakes, urine test additives, and related items;

13. Endangered species which includes plants, animals or other organisms (including product derivatives) in danger of extinction; 

14. Gaming/gambling which includes lottery tickets, sports bets, memberships/ enrolment in online gambling sites, and related content; 

15. Government IDs or documents which includes fake IDs, passports, diplomas, and noble titles;

16. Hacking and cracking materials which includes manuals, how-to guides, information, or equipment enabling illegal access to software, servers, website, or other protected property;

17. Illegal goods which includes materials, products, or information promoting illegal goods or enabling illegal acts; 

18. Miracle cures which includes unsubstantiated cures, remedies or other items marketed as quick health fixes;

19. Offensive goods which includes literature, products or other materials that:

20. Defame or slander any person or groups of people based on race, ethnicity, national origin, religion, sex, or other factors;

21. Encourage or incite violent acts;

22. Promote intolerance or hatred.

23. Offensive goods, crime which includes crime scene photos or items, such as personal belongings, associated with criminals; 

24. Pyrotechnic devices, combustibles, corrosives and hazardous materials which includes explosives and related goods; toxic, flammable, and radioactive materials and substances; 

25. Regulated goods which includes air bags; batteries containing mercury; Freon or similar substances/refrigerants; chemical/industrial solvents; government uniforms; car titles; license plates; police badges and law enforcement equipment; lock-picking devices; pesticides; postage meters; recalled items; slot machines; surveillance equipment; goods regulated by government or other agency specifications; 

26. Securities which includes government bonds or related financial products;

27. Tobacco and cigarettes which includes cigarettes, cigars, chewing tobacco, and related products;

28. Traffic devices which includes radar detectors/jammers, license plate covers, traffic signal changers, and related products;

29. Weapons which includes firearms, ammunition, knives, brass knuckles, gun parts, and other armaments;

30. Wholesale currency which includes discounted currencies or currency exchanges;

31. Live animals or hides/skins/teeth, nails and other parts etc. of animals;

32. Multi-Level Marketing collection fees;

33. Matrix sites or sites using a matrix scheme approach;

34. Drop-shipped merchandise;

35. Any product or service which is not in compliance with all applicable laws and regulations whether federal, state, local or international, including the laws of India; 

36. The merchants providing services that have the potential of casting the Payment Gateway Facilitators in a poor light and/or that may be prone to Buy & Deny attitude of the cardholders when billed (e.g. Adult material/ Mature content/Escort services/ friend finders) and thus leading to chargeback and fraud losses;

37. Businesses or website that operate within the scope of laws which are not absolutely clear or are ambiguous in nature (e.g. Web-based telephony, Website supplying medicines or controlled substances, website that promise online match-making); 

38. Businesses out rightly banned by law (e.g. Betting & Gambling/ publications or content that is likely to be interpreted by the authorities as leading to moral turpitude or decadence or incite caste/communal tensions, lotteries/sweepstakes & games of chance; 

39. The merchants who deal in intangible goods/ services (e.g. Software download/ Health/ Beauty Products), and businesses involved in pyramid marketing schemes or get-rich-quick schemes. Any other product or Service, which in the sole opinion of CRED, is detrimental to the image and interests of CRED, as communicated by either of them/ both of them to the merchant from time to time. This shall be without prejudice to any other terms & conditions mentioned in these Terms and Conditions;

40. Bulk marketing tools which includes email, lists, software, or other products enabling unsolicited email messages (spam);

41. Web-based telephony/ SMS/Text/Facsimile services or Calling Cards. Bandwidth or Data transfer/ allied services. Voice process /knowledge process services; and

42. Mailing lists

43. Money laundering services.

44. Database providers (for tele-callers). 

45. Bidding/Auction houses.

46. Firms promoting business opportunities, investment opportunities and mortgage

B.8. Offers

CRED may from time to time make available either directly or in partnership with its Commercial Partners, certain benefits for using CRED Max. All such offers shall be governed by their terms and conditions displayed on the CRED App in addition to these CRED Max T&Cs. CRED’s decision of the winner of such offers shall be final and binding and not subject to any appeal or dispute resolution process.

Section C: Supplemental Terms for CRED Store

The following terms and conditions (“CRED Store T&Cs”) are specific to accessing / using the e-commerce marketplace on the CRED App, where various products, services, travel packages, experiences may be listed for purchase (“CRED Store”). All Users accessing CRED Store shall be deemed to have read, understood and agreed to be bound by these CRED Store T&Cs.

C.1. Nature of CRED Store

CRED Store is a curated e-commerce platform whereby CRED acts as a marketplace for third party sellers (Sellers) to list their products and offer attractive products or services to the Users. For the avoidance of doubt, it is clarified that CRED does not maintain any inventory or control over inventory of the products listed on the CRED Store and only provides a marketplace platform (including payment and settlement solution to the Sellers listing the products or services).

C.2. Use of Store

a. For purchasing products on the CRED Store, the User may either (i) pay the full price as listed on CRED Store for such product; or (ii) avail a lower price as listed on CRED Store, by utilising CRED Coins.

b. The number of CRED Coins needed to avail a discount on each specific product shall be decided by CRED. CRED, in its sole discretion, may choose to alter the number of CRED Coins needed to claim a reward on any product at any point of time.

c. For the avoidance of doubt, it is hereby clarified that:

(i) CRED shall not be liable for any defects in the goods sold by the Sellers and does not provide any warranty for any products. Warranty, if any, shall be provided by the Seller. CRED recommends that each User verify the applicability of warranty terms in respect of each product before purchasing the same through CRED Store.

(ii) CRED shall not be liable for any claims arising in relation to the delivery of the products or the quality of the goods / services purchased by the User.

(iii) the return, replacement and/ refund in relation to such products shall be dealt with in the manner as provided in CRED’s policies, as available on CRED Website / other CRED Platforms; and

(iv) delivery of the products is the sole responsibility of the respective Seller. The delivery service may not be available for all pin codes and the User must verify if the delivery service is available at the pin code provided by the User prior to placing an order.

C.3. Pricing & Availability

a. We list availability information for products sold by us on the App, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just estimates. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail if any products you order turn out to be unavailable.

b. All prices are listed in Rupees. Items in your cart will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your cart and the time you purchase it.

c. All prices displayed are inclusive of Goods and Services Tax ("GST"), duties and cesses as applicable - unless stated otherwise.

C.4. Offers

CRED may from time to time make available either directly or in partnership with Sellers, certain benefits for using CRED Store. All such offers shall be governed by their terms and conditions displayed on the CRED App in addition to these CRED Store T&Cs. CRED’s decision of the winner of such offers shall be final and binding and not subject to any appeal or dispute resolution process.

C.5. Cancellation, Returns and Refunds

Orders for goods once placed cannot be cancelled. Orders for travel packages are subject to relevant cancellation policy for each package. CRED’s general return and refund policy is as set out – here. Certain products may have differing return / refund terms as set out in the CRED App. 

C.6. Grievance Redressal / Nodal Officer

Should You have any issues or queries in relation to CRED Store, You may reach out to the CRED’s customer support team using the chat function on the CRED App. In the event that You are not entirely satisfied with the response, You may raise your grievance to the grievance redressal officer.

CRED has appointed a grievance redressal to address any grievances in respect of CRED Store. Details of the said officer are as set out below:

Following the procedure adopted for redressal of grievances, Grievance Redressal officer shall acknowledge all grievances within 48 (forty-eight) hours of receipt and shall address them within a period of 1 (one) month. The Grievance Redressal Officer as set out above, also acts as the nodal officer to ensure compliance with various applicable laws and regulations including the Consumer Protection (E-Commerce) Rules, 2020.

Section D: Supplemental Terms for CRED Rewards

The following terms and conditions (“CRED Rewards T&Cs”) are specific to accessing various offers on the Rewards section on the CRED App (“CRED Store”)  or any other rewards / referral programs or offers anywhere on the CRED App. All Users accessing CRED Rewards shall be deemed to have read, understood and agreed to be bound by these CRED Rewards T&Cs.

D.1.  Participation in the Rewards Section

a. Rewards may be of various types including but not limited to Mystery Rewards, Jackpot Rewards, Raffle Rewards, Spin the Wheel Rewards, Arcade Rewards, and CRED Pay offer unlock rewards (‘Reward Promotions’)

b. CRED awards each User with pre-designated number of loyalty points for their regularly and continuous use of the CRED App. The Coins awarded to the User are at the sole discretion of CRED.

c. Users can participate in any Reward Promotion only by using the Coins awarded to them by CRED.

d. CRED does not permit any User to purchase any Coins using real world money, to enter the Reward Promotions. None of the reward promotions include betting or wagering of real-world money.

e. Participation in any Reward Promotion is completely voluntary. Users may choose to not participate in any Reward Promotion. CRED does not guarantee any prize to any winner.

f.  Users must not participate in the Reward Promotions if they are specifically prohibited from participating by state, municipal or other local area body laws from participating in such promotions or if such Reward Promotions are not permitted to be offered within such jurisdictions.

D.2. Prizes

a. The prizes for a Reward Promotion may be given by CRED and /or by CRED’s Commercial Partners.

b. The Users may be required to create an account / register / sign up etc on a Commercial Partner’s website, app or physical location to avail full benefit of the prizes offered.

c. Some prizes may be available only in specified geographies or for specified time duration.

d. CRED may at its sole discretion require users to provide PAN, proof of identity and proof of residence before confirming a User as the winner.

e. CRED may at its discretion require a user to agree to feature in CRED’s advertisement or promotional / marketing material as a condition for receiving the prize in a Reward Promotion.

D.3. Disclaimers

a. The Reward Promotions are offered to the Users on an “as is” basis and without warranty or condition. The Reward Promotions may not be uninterrupted or error-free. Users waive all claims against CRED.

b. Selection of the winner by CRED shall be final, binding and not subject to any dispute settlement procedures.

c. Where the rewards are in the nature of coupons or vouchers, the Users must contact the Commercial Partner offering the coupon or voucher for any customer support or queries.

d. CRED reserves the right to deactivate or delete the User account, all related information on it, and forfeit all Coins or related prizes from any User, in the event of misuse of the offer, fraud or suspicious transaction/activity on the CRED App or any other CRED Platform.

e. CRED is not responsible for any tax implications on the User from their participation in any Reward Promotion. Users should obtain an independent tax advice before entering any Reward Promotion.

D.4. Kill the Bill Offers

CRED reserves the right to modify or suspend the KTB Offer at any time without prior notice to the Users. No person is guaranteed any rewards or cashback in respect of the KTB Offer. CRED does not guarantee that any User shall be eligible for any offer or that the benefits offered will be same or similar to all users.

D.5. Referral Rewards Program

a. Duration and Eligibility: The leaderboard of the Referral Reward Program (“Reward Program”) for August shall open at 04:50 PM on August 6, 2024 and remain open until 11:59 PM on August 13, 2024 (“Reward Duration”). Winner(s) of the prize(s) shall be announced on August 14, 2024. To be eligible for the Prize(s), a participating CRED user (“Participant”) must refer new users (“Referred User(s)”) within the Reward Duration using the link provided on the CRED App. The Referred User(s) must download and use the CRED App, by making a payment of ₹100 or more, within the Reward Duration. Winner(s) of the prize(s) will be chosen based on the number of successful referrals made during the Reward Duration. A referral is considered successful only when a Referred User makes a payment of ₹100 or more on the CRED App within the Reward Duration. Any incomplete referrals or referral cycles finished after the Reward Duration shall not be considered. In the event of a tie, the time stamps showing the time of signing up by a Referred User shall be compared and the earlier time stamp shall be used to break the tie. 

b. Rewards and Fulfillment: CRED may contact winner(s) via email or residential address for delivery of the prize(s). By participating, the Participants agree to provide their email ID, residential address and PAN details to CRED. CRED shall endeavour to deliver the prize(s) within 30 days of receipt of all relevant information/ consent from the winner(s). By participating, the Participants consent to the use and display of their name on the CRED app. The winner(s) shall be solely responsible for any TDS implications related to the prize(s). CRED reserves the right to disqualify any Participant and choose a new winner if any instance of abuse, fraudulent or suspicious activity is detected with respect to their use of the CRED app or participation in the Reward Program. 

c. General Terms: By participating, the Participants agree to these terms and any additional terms communicated by CRED. CRED reserves the right to modify these terms and conditions and the prize(s) at any time. CRED shall have the right, at its sole discretion, to provide/ revoke access to the Referral Reward Program to any select group of CRED users. CRED shall determine the nature of prizes to given to the winner(s). CRED shall not be responsible for any technical issues or interruptions from the Participant’s end that adversely affect their participation. The prize(s) are non-transferable and cannot be exchanged for other prizes or cash. CRED reserves the right to discontinue or suspend the Reward Program at any time. CRED shall not be liable for any loss, damage, or injury arising from participation or prize acceptance. All decisions by CRED are final, binding and not subject to any dispute settlement procedures. If CRED cannot contact a Participant within a reasonable time according to CRED or if the Participant does not cooperate with CRED, CRED has the right to deny any prize offered to such Participant.

Section E: Supplemental Terms for CRED Pay for Customers and Merchants

The following terms and conditions (“CRED Pay T&Cs”) are specific to CRED Pay, the product from CRED which allows users to pay on various third-party websites and applications (“Merchant”) using the Users’ cards or other payment instruments saved on the CRED App. All Users and Merchants using CRED Pay shall be deemed to have read, understood and agreed to be bound by these CRED Rewards T&Cs.

E.1. Key attributes of CRED Pay

a. CRED Pay allows Users to pay on various websites and applications using the Users’ cards or other payment instruments saved on the CRED App.

b. CRED Pay is only a payment instrument selection mechanism and the Merchant remains fully responsible for actual provision and quality of the products or services paid for by the Users.

E.2. Loyalty Points based Offers

a. CRED may offer certain additional benefits on paying via CRED Pay including but not limited to cashbacks or instant discounts subject to the User utilising his/her CRED Coins to avail a particular offer.

b. CRED may introduce, vary and withdraw such offers at its discretion without prior notice to the Users. Different sets of Users may have different offers from time to time.

c. CRED does not guarantee that any User shall be eligible for any offer or that the benefits offered will be same or similar to all users.

E.3. Payment Aggregator Services

a. CRED, through its CRED Group Entity, Dreamplug PayTech Solutions Private Limited (“Payment Aggregator”), has developed of certain technology systems which enable various Merchants to receive payments for transactions made by Users on the platforms of such Merchants (“Payment Aggregator Services”). CRED / Payment Aggregator may also deploy the services of any other third party payment gateways or payment aggregators. The Payment Aggregator services include, enabling collection and settlement of online payment transactions towards the purchase of goods and services of the Merchants, a dashboard service, API integration, and such other services as may be notified by the Payment Aggregator, from time to time at its sole discretion.

b. Currently, the Payment Aggregator Services are only available to select Merchants in India, and require the Merchant to enable CRED Pay as a payment option on their websites/apps.

c. Prior to enabling CRED Pay / Payment Aggregator Services for any Merchant, the Merchant is required to (i) approach the merchant onboarding team of the Payment Aggregator or apply via partner.cred.club; (ii) provide any information and documents required by the Payment Aggregator to conduct the necessary due-diligence and KYC in relation to the Merchant, in the format required by the Payment Aggregator; (iii) get onboarded as a merchant with the Payment Aggregator by executing an agreement with CRED / Payment Aggregator (“Merchant Agreement”). The Merchant shall, at all times, comply with the provisions of such Merchant Agreement in letter and in spirit.

d. The scope of Payment Aggregator Services, including the terms of use and manner of availability, is subject to amendments from time to time, which shall be notified to Merchants upon any material amendments being implemented.

e. The Merchant undertakes not to access or attempt to access the Payment Aggregator Services by any means other than through the interface that is provided by the Payment Aggregator and in the manner permitted thereby. The Merchant specifically undertakes not to access or attempt to access the Payment Aggregator Services through any automated means (including by use of scripts or web crawlers).
